Open Municipal Government Toolkit – Code of Conduct

Section 107 of the Municipal Government Act requires that a Code of Conduct Bylaw by brought into effect to govern the conduct of council members. This bylaw must be in place within 12 months of the Municipal Government Act coming into effect.
The Department of Fisheries and Communities has created a sample bylaw. This sample bylaw incorporates the principles of open government: accountability, transparency and accessibility.

Although not required by the Municipal Government Act, implementing a Code of Conduct declaration is one way of demonstrating commitment to open government and good governance. By signing the code of conduct declaration, each council member acknowledges that they have read and agree to abide with the municipality’s Code of Conduct Bylaw. The declaration outlines the expected standards of conduct and council member responsibilities.
Council may choose to make the Code of Conduct Declaration accessible to the public as a best practice.
